The second‑review draft of the anti‑cross‑border corruption law, submitted to
the 25th session of the 14th National People’s Congress Standing Committee on
the 2nd, expands the statute’s legislative purpose and strengthens principles
guiding anti‑cross‑border corruption work. The draft adds a provision to
“promote building a fair and reasonable global anti‑corruption governance
system” and specifies that “anti‑cross‑border corruption work shall strictly
follow the Constitution and the law, observe legal procedures, and respect and
protect human rights.” It sets rules on agencies’ use of information technology
in anti‑corruption work and requires that “relevant agencies and their staff
bear legal confidentiality obligations for state secrets, work secrets,
commercial secrets, personal privacy and personal information learned during
supervision and investigation.” The draft further requires domestic firms
engaged in cross‑border operations to, based on company size, business scope and
risk controls, reasonably establish integrity and compliance departments or
personnel.
