The Department of Justice has appealed a federal judge’s Oct. 13 order barring
the Trump administration from enforcing its Sept. 18 revocation of White House
press access for CNN, MSNBC and Politico during litigation. U.S. District Judge
Timothy J. Kelly found the outlets are likely to prevail and said the
revocations may violate the First Amendment and the Fifth Amendment’s
notice-and-hearing protections. The administration revoked access citing
unfavorable coverage; the three outlets sued alleging viewpoint-based
discrimination.
