California Governor Gavin Newsom signed AB 1883 on Wednesday, prohibiting
employers from collecting employees’ brain-activity data or using AI-driven
monitoring to infer workers’ emotional states. The law bars employer use of
systems — including video and audio surveillance, continuous time trackers,
geolocation and electromagnetic tracking — when those systems employ AI to
gather neural data or identify emotions. Violations carry civil fines up to $500
per incident; enforcement will be handled by the state labor commissioner and
the attorney general.
