On Sept. 2, lawyers for Venezuelan President Nicolás Maduro filed a motion in
the U.S. District Court for the Southern District of New York seeking dismissal
of the fourth superseding indictment against him on grounds of immunity. Judge
Alvin K. Hellerstein scheduled a hearing for Nov. 17, 2026. The defense
submitted a legal memorandum, a declaration by Pollak and multiple attachments,
including a Jan. 3, 2026 decision from Venezuela’s Supreme Court Constitutional
Chamber, a United Socialist Party document and two Italian court rulings. The
filing does not constitute dismissal; prosecutors will respond and the judge
will decide whether the immunity claim can bar the U.S. charges.
